Mediation

A neutral mediator helps both sides reach their own agreement, confidentially.

Mediation is voluntary and confidential. The mediator does not decide the dispute but helps the parties talk, understand each other's interests and settle. It is governed by the Mediation Act, 2023 and, for commercial disputes, Section 12A of the Commercial Courts Act, 2015, which makes pre-institution mediation mandatory in most cases.

A mediated settlement agreement is binding on the parties and can be enforced like a court order.

People usually come to us when you want to settle without the cost and delay of a trial; the relationship matters, as with family, partners or neighbours; a court has referred your case to mediation.

How we can help

  • Representing you in mediation and preparing your position
  • Pre-litigation mediation for commercial, family and property disputes
  • Court-referred mediation in pending cases
  • Drafting and recording the settlement agreement
  • Acting as mediator in suitable matters

These matters are heard before: Court-annexed mediation centres, private mediation.
